These Terms and Conditions (“Terms”) govern the use of the QuickGenie+ Membership Program (“Membership”), provided by QuickDesk Solutions LLC dba QuickGenie (“QuickGenie,” “we,” “us,” or “our”). By enrolling in or using your QuickGenie+ Membership, you agree to abide by the terms outlined below.

1. Membership Eligibility and Ownership

1.1 QuickGenie+ Essential and Pro memberships are available to residential customers only.

1.2 Business or commercial use is not permitted under these plans. Businesses may enroll in the QuickGenie+ Business Pro membership or request a custom Managed IT agreement.

1.3 Memberships are issued to an individual and are non-transferable. Benefits may only be used by the account holder and apply solely to their devices and service location. Any attempt to share or transfer membership privileges may result in termination without refund.

1.4 Members must be at least 18 years of age and legally capable of entering into binding agreements.

1.5 QuickGenie reserves the right to decline or revoke any membership enrollment at its sole discretion, without obligation to provide a reason. This may include, but is not limited to, factors such as geographic location, prior account misuse, payment irregularities, or other circumstances deemed unsuitable by QuickGenie.

2. Term and Renewal

2.1 Memberships are offered on a monthly or annual basis.

2.2 Annual plans are billed in full at the start of the term and are non-refundable once activated.

2.3 Memberships automatically renew unless canceled prior to the renewal date.

3. Member Benefits and Limitations

3.1 Benefits vary by plan tier. Only the services explicitly listed in the Membership Overview are included.

3.2 Any service not listed (e.g., data recovery, virus removal, OS reinstallation) is not included and will be billed at current standard or member-discounted rates.

3.3 Remote support sessions are limited to software-only issues and must be resolved in under 60 minutes. Sessions beyond 1 hour may incur additional charges.

3.4 Pro members are entitled to one (1) free on-site visit per year, up to one (1) hour. Additional time is billed at the member-only rate.

4. Scheduling and Service Access

4.1 All services, including drop-offs/ pick-ups must be scheduled in advance via phone, text, or email. 

4.2 Walk-ins are accepted, but scheduled members receive priority.

4.3 QuickGenie aims to respond and schedule service requests within 24–48 business hours, subject to availability.

4.4 Pro members may receive priority scheduling, including access to weekend appointments, when available.

5. Preventive Maintenance

5.1 Preventive maintenance may be performed in-store or on-site.

5.2 In-store maintenance is unlimited in duration for covered devices and includes physical cleaning.

5.3 On-site maintenance is limited to one hour as part of the Pro member’s free visit. Additional time will be billed at the standard member rate.

6. Data Backup and Risk Disclosure

6.1 Members are solely responsible for backing up all data prior to any service or repairs.

6.2 QuickGenie shall not be liable for any data loss, software malfunction, or hardware failure occurring during or after service.

6.3 By accepting service, members agree to release QuickGenie from liability related to any loss or damage to files, data, or installed programs.

7. Service Availability and Geographic Limitations

7.1 QuickGenie+ Membership services are currently available only within the Bay Area, specifically Santa Clara County and nearby counties.

7.2 On-site service requests located more than 15–20 miles from Santa Clara or requiring over 20 minutes of travel time may incur additional travel charges, which will be disclosed at the time of scheduling.

7.3 QuickGenie reserves the right to decline on-site service requests that fall outside of its defined service area.

7.4 Remote support is available to all members regardless of location, provided that a reliable internet connection is available.

8. Service Usage and Expiration

8.1 Included benefits (e.g., support sessions, on-site visits) do not roll over if unused within the applicable period.

8.2 Members are encouraged to utilize their benefits regularly to maximize plan value.

9. Cancellation

9.1 Monthly plans may be canceled anytime, with service continuing through the end of the current billing cycle.

9.2 Annual plans are non-refundable, except where required by law.

9.3 Membership may be suspended or terminated by QuickGenie at its sole discretion in cases of abuse, fraud, or breach of these Terms.

10. Modifications

QuickGenie reserves the right to modify, update, or discontinue any part of the Membership program, including pricing, benefits, or terms, at any time with or without notice. Continued use of the Membership after such modifications constitutes acceptance.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKGENIE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF BUSINESS, OR LOSS OF PROFITS.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE MEMBERSHIP PROGRAM SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE MEMBERSHIP DURING THE PREVIOUS TWELVE (12) MONTHS.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Santa Clara County, California.
